Resumen: El prese nte trabajo analiza la crisis sísmic a ocurrida en Venezuela en
2026 bajo la óptica del Derech o Fundamental a la Buena Administ ración, conce-
bido como un derecho humano y colectivo exigible. A través de un análisis jurídi-
co-administrativo, se documenta la negligencia del Estado al ignorar advertencias
técnicas previas de organismos como JICA y FUNVISIS, lo cual configura una
omisión antijurídica en su deber de protección. El estudio detalla las violaciones
sistemáticas a la Consti tución de 1999 (específica mente los artículos 55, 8 3, 135,
140, 141, 156 y 338) derivadas de la gestión ineficiente de la emergencia, la opa-
cidad informativa y la obstrucción de la ayuda humanitaria y civil. Finalmente, se
propone la implementación de una Gobernanza Multinivel y la creación de una
Agencia Nacional de Fiscalización de Normas Sismorresistentes con autonomía
técnica, con el fin de institucionalizar la resiliencia urbana y g arantizar la respon-
sabilidad patrimonial y penal de los funcionarios ante desastres evitable s.

Abstract: This paper analyzes the 2026 seismic crisis in Venezuela through the
lens of the Fundamental Right to Good Administration, understood as an enforcea-
ble human and collective right. Using a legal-administrat ive framework, it docu-
ments the State's negligence in ignoring prior technical warnings from organiza-
tions such as JICA and FUNVISIS, which constitutes an unlawful omission of its
duty of protection. The study details systematic violations of the 1999 Constitution
(specifically Articles 55, 83, 135, 140, 141, 156, and 338) resulting from inefficient
emergency management, infor mation opacity, and the obstructi on of humanitarian
and civil aid. Finally, the implementation of Multilevel Governance and the crea-
tion of an Autonomous National Agency for Seismic Standard Oversight are pro-
posed to institutionalize urban resilience and ensure the State’s financial and crim-
inal liability in the face of avoidable disasters.

Las presente líneas las escribo, a escasos días de una tragedia que devastó la ciudad cos-
tera de La Guaira y afectó una cantidad importante de inmuebles en Caracas, Maracay y otras
poblaciones, que para estos días, no se conoce exactamente la cantidad de muertos, despare-
cidos ni la cuantificación de daños materiales. Ante el caos, la población se activó inmedia-
tamente, buscando rescatar a familiares o ayudando a rescatar a familiares de otros. Incluso,
personas afectadas psicológica, material y/o físicamente ayudando al prójimo.
