Vista la solicitud de la Defensora C.M., de la práctica de examen médico al ciudadano V.J.P., venezolano, mayor de edad, titular de la cédula de identidad N° 3.606.258; este Tribunal acuerda, por no ser contraria a derecho y en aras de garantizar los derechos ciudadanos del penado, entre ellos el derecho a la salud como parte integrante del derecho a la vida; se acuerda oficiar a la Dirección del Internado Judicial de Cumaná, para que realice las gestiones necesarias para el traslado del penado al Hospital Universitario “Antonio Patricio de Alcalá” de Cumaná para que se le realice una evaluación general sobre el estado de salud de dicho penado, del mismo modo, dicha Dirección deberá informar a este despacho la fecha en que fue atendido en dicho centro asistencial, con el objeto de que este Despacho recave el informe debido, finalmente se acuerda notificar a la defensa para que a la brevedad posible consigne ante este Tribunal todo los recaudos médicos, tales como informes, exámenes y otros a los que pudiere tener acceso y que demuestren el estado de salud del penado en cuestión, con la finalidad de estudiar la posibilidad de alguna medida alternativa al cumplimiento de pena.
Todo con fundamento a lo previsto en el artículo 10 y 479 del Código Orgánico Procesal Penal. Ofíciese a la dirección del Internado Judicial de Cumaná para su traslado al Hospital Universitario de Cumaná y notifíquese a la defensa. Es todo. Cúmplase.
