RESUMEN
El objetivo general de la investigación fue analizar la vulneración de derechos y
bienestar infantil en establecimientos penitenciarios de Perú. Se abordó desde un
método cuantitativo, centrándose en la recolección de datos para generar información
descriptiva. Este proceso se complementó con una exhaustiva revisión documental-
bibliográfica. Se aplicó un cuestionario para la recolección de datos a un total 30
madres y padres recluidos en el Centro Penitenciario “El Milagro” en el Distrito de El
Milagro, Provincia de Trujillo, Departamento de La Libertad, que tienen hijos de 0 a 03
años. Además, se aplicaron los métodos inductivo-deductivo y analítico-sintético. Se
concluye que, la presencia de niños en establecimientos penitenciarios genera una
vulneración significativa de sus derechos fundamentales y compromete su bienestar
integral e impiden un desarrollo óptimo, evidenciando la necesidad urgente de
medidas que prioricen el interés superior del niño fuera de estos ambientes
restrictivos.

ABSTRACT
The general objective of the research was to analyze the violation of rights and child
welfare in penitentiary establishments in Peru. It was approached from a quantitative
method, focusing on data collection to generate descriptive information. This process
was complemented with an exhaustive documentary-bibliographic review. A
questionnaire for data collection was applied to a total of 30 mothers and fathers
imprisoned in the “El Milagro” Penitentiary Center in the District of El Milagro, Province
of Trujillo, Department of La Libertad, who have children from 0 to 03 years of age. In
addition, the inductive-deductive and analytical-synthetic methods were applied. It is
concluded that, the presence of children in penitentiary establishments generates a
significant violation of their fundamental rights and compromises their integral
wellbeing and prevents an optimal development, evidencing the urgent need for
measures that prioritize the best interest of the child outside these restrictive
environments.
