Revisadas como han sido las actas que conforman el presente asunto, contentivo de CONVENIMIENTO DE RÉGIMEN DE CONVIVENCIA FAMILIAR, suscrito por los Ciudadanos, YANGEL D.P.U., Venezolano, mayor de edad, titular de la Cédula de Identidad Nº V-18.387.861, residenciado en la calle sucre, con calle Libertad, casa s/n, al frente de donde quedaba la DIEX, Parroquia A.G., de esta Ciudad, teléfono de ubicación 0416-1829772, de profesión u oficio auxiliar de farmacia, y JEXSI C.S.S., Venezolana, mayor de edad, titular de la Cédula de Identidad Nº V-18.387.634, residenciada en la vía nacional de Paloma, casa s/n, punto de referencia al lado de la Chevrolet de esta ciudad, teléfono de ubicación 0426-7958720, convenimiento éste suscrito por ante el Fiscal Cuarto del Ministerio Publico de Protección de Niños, Niñas y Adolescentes, Civil e Instituciones Familiares de la Circunscripción Judicial del Estado D.A., en fecha 06 de mayo de 2014, en beneficio de su hijo, (se omite el nombre de conformidad con lo establecido en el artículo 65 de la Ley Orgánica para la Protección de Niños, Niñas y Adolescentes), quien cuenta con seis (06) años de edad. El referido convenimiento, fue suscrito por los Ciudadanos antes identificados en los siguientes términos:
El padre se llevara a su hijo un fin de semana cada 15 dias, lo buscara el día viernes a las 12:00 p.m. y lo entregara el domingo a las 4:00 p.m.
El padre se llevara a su hijo en vacaciones escolares desde el 01 de agosto de cada año hasta el 23 de agosto de cada año.
El padre se llevara a su hijo en la semana del 31 de diciembre de este año, y se alternara el año siguiente con la madre en la semana del 24 de diciembre
El padre se llevara a su hijo en la semana de carnaval, y se alternara con la madre el año siguiente con la semana santa.
Ahora bien, visto que el acuerdo suscrito por los padres respecto a su hijo, no es contrario a derecho ni lesionan sus intereses legítimos, al contrario satisface el derecho que les asisten a un nivel de vida adecuada dentro de las posibilidades de sus progenitores, previsto en el artículo 30 de la Ley Orgánica Para la Protección de Niños, Niñas y Adolescentes, este Tribunal Primero de Primera Instancia de Mediación, Sustanciación y Ejecución del Circuito Judicial de Protección de Niños, Niñas y Adolescentes de la Circunscripción Judicial del Estado D.A., con fundamento en lo dispuesto en los artículos 8, 27, 385, 387, 518 de la Ley Orgánica para la Protección de Niños, Niñas y Adolescentes, Administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, imparte la HOMOLOGACIÓN correspondiente, adquiriendo efectos de sentencia definitivamente firme y ejecutoriada. A tal efecto, expídanse las copias certificadas que las partes soliciten, guardando el original del presente convenimiento en el Archivo Sede de este Tribunal. De igual manera, devuélvase acta de convenimiento, debidamente certificada al Fiscal Cuarto del Ministerio Público de Protección de Niños, Niñas y Adolescentes, Civil e Instituciones Familiares de la Circunscripción Judicial del Estado D.A., con inserción de la presente Resolución Homologatoria.
