Vista la solicitud presentada por su firmante, Ciudadana: M.D.J.B., titular de la Cédula de Identidad Nº V-8.167.077, asistido por el Abogado en Ejercicio: L.A.P.., inscrito en el Inpreabogado bajo el Nº 27.200, así como las declaraciones de testigos, cursante a los folios 05 y 07. Admítase cuanto ha lugar en derecho la anterior solicitud, por no ser contraria al orden público, a las buenas costumbres o ha alguna disposición expresa de la ley. En consecuencia, este Tribunal Primero del Municipio Achaguas de la Circunscripción Judicial del Estado Apure, administrando Justicia en nombre de la Republica Bolivariana de Venezuela y por autoridad de la Ley, de conformidad con lo dispuesto en el artículo 937 del Código de Procedimiento Civil y sin perjuicio de terceros de igual o mejor derecho, Declara TITULO SUPLETORIO BASTANTE DE PROPIEDAD Y POSESIÓN, a favor de la Ciudadana: M.D.J.B., titular de la Cédula de Identidad Nº V-8.167.077, domiciliado en el Municipio Achaguas del Estado Apure, sobre unas bienhechurías, ubicadas en la zona urbana, Sector Caja de agua, del Municipio Achaguas- Estado Apure, que se determinan en la solicitud y mediante el justificativo de testigos evacuado por ante este Tribunal, Cuyas bienhechurías se encuentran construidas sobre una parcela de terreno de propiedad del Municipio Achaguas-Estado Apure, que le fue otorgado en Calidad de Arrendamiento, según contrato expedido por la Sindicatura Municipal, registrado bajo el Nº 001, folios 028-029, de fecha 29-08-2011, en un lote de terreno constante de ONCE METROS CON NOVENTA CENTIMETROS DE FRENTE POR CUARENTA Y SEIS METROS CON CINCUENTA CENTIMETROS DE FONDO (11 MTRS, 90 CTM x46 MTRS,50 CTM), bajo los siguientes linderos: Norte: Vereda y Casa de C.H.; Sur: Próxima Calle; Este: Calle caujarito; Oeste: Casa de Josè Ascanio; y las referidas bienhechurías son descritas de la siguiente forma: Una (01) Casa en construcción la cual posee seis (06) columnas de concreto de cemento con capacidad Dos (02) plantas con paredes de bloques de cemento frisada, cuenta con los servicios de luz eléctrica, aguas blancas y servidas y totalmente cercada con alambre púa y estantes de madera; siendo el valor de las bienhechurías la cantidad de VEINTICINCO MIL BOLIVARES (Bs. 25.000.ºº). Devuélvase original de estas resultas al solicitante y dejar copia certificada de lo actuado, quedando anotado en el libro de solicitudes llevados por este tribunal durante el presente año 2.012, bajo el Nº 12-20.
Publíquese, regístrese y déjese copia certificada de conformidad con el artículo 248 del código de procedimiento civil, en concordancia con el artículo 72 ordinales 3 y 9 de la ley organiza del poder judicial.
Dada, firmada y sellada en la Sala de Despacho del Juzgado Primero del Municipio Achaguas de la Circunscripción Judicial del Estado Apure, a los Nueve (09) días del mes de Febrero del año Dos Mil Doce. (2.012). Años 200º de la independencia y 152º de la Federación.
