JUZGADO SEGUNDO DE LOS MUNICIPIOS PALAVECINO Y SIMON PLANAS DE LA CIRCUNSCRIPCION JUDICIAL DEL ESTADO LARA.

Años: 199° y 150°.-
Vista la demanda por COBRO DE BOLIVARES VÍA INTIMACIÓN, presentada por el Abogado: J.E.R.R., inscrito en el Inpreabogado bajo el N° 30.640, con domicilio procesal en la carrera 18, esquina calle 27, Edificio Torre Campanario, 4to. Piso, Oficinas 4-A y 4-B, Barquisimeto Estado Lara, en su carácter de Endosatario en Procuración del ciudadano J.G.N., venezolano, mayor de edad, titular de la Cédula de Identidad N° 14.466.935, en contra del ciudadano E.B., venezolano, mayor de edad, titular de la Cédula de Identidad N° 19.106.389, domiciliado en la Urbanización Ribereña II, Terraza Nº 7, Cabudare, Municipio Palavecino del Estado Lara, désele entrada y anótese en los libros correspondiente. Y revisadas las actuaciones que anteceden, conformadas por el libelo de demanda y la letra de cambio, objeto fundamental de la presente acción, este Tribunal Administrando Justicia en nombre de la República y por autoridad de la ley, declara INADMISIBLE la demanda por COBRO DE BOLIVARES VÍA INTIMACIÓN, presentada, por cuanto la parte demandante carece del carácter con el que dice actuar, siendo que la especie cambiara acompañada adolece del señalado endoso en procuración, ello de conformidad con lo establecido en el artículo 642primera parte del Código de Procedimiento Civil, en concordancia con los artículos 340, numeral 2° y 341 eiusdem.
