GADO PRIMERO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y DEL TRANSITO DE LA CIRCUNSCRIPCION JUDICIAL DEL ESTADO TÁCHIRA. - San Cristóbal, veintiocho de mayo de dos mil siete.-
196° y 147°
Recibido por Distribución, constante de un (01) folio útil el escrito junto con anexos, constante todo de veinte (07) folios útiles. Fórmese expediente, inventaríese, désele entrada y el curso de ley correspondiente. Y visto el escrito presentado por el ciudadano A.D.R.D.F.R.S., venezolano, soltero, mayor de edad, titular de la Cédula de Identidad N° V-4.110.529, hábil y de este domicilio, asistido en este acto por la abogada M.E.R.P., inscrita en el Inpreabogado bajo el N° 66.575; en el que expone: “…que el día 07 de Abril de 2006, falleció ab intestato, en esta ciudad de San Cristóbal, Estado Táchira, su hijo, el ciudadano HALMER YARDANI ROA NOVOA, quien en vida fuera venezolano, mayor de edad, titular de la cédula de identidad N° V-16.228.023; tal y como se evidencia del Acta de Defunción N° 028, Folio 128, expedida por la Primera Autoridad Civil del Municipio Vargas, Estado Vargas, que anexa marcada “A”,. Anexa también a la presente, Justificativo de Testigos evacuado por ante el Notario Público Segundo de San Cristóbal, Estado Táchira, de fecha 13 de marzo de 2007. En consecuencia, este JUZGADO ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPÚBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY declara las presentes diligencias bastantes y suficientes para asegurarle al ciudadano A.D.R.D.F.R.S., ya identificado, en su condición de padre, el carácter de UNICO Y UNIVERSAL HEREDERO DEL FALLECIDO HALMER YARDANI ROA NOVOA.-
De conformidad con el artículo 937 del Código de Procedimiento Civil, Se deja a salvo TODOS LOS DERECHOS DE TERCEROS.-
Déjese copia certificada de las actuaciones para el archivo del Tribunal y devuelvase los originales de las mismas al
interesado a los fines legales.-
