Mediante decisión N° 1292 del 9 de diciembre de 2010, la Sala Constitucional admitió el recurso de nulidad ejercido por el ciudadano A.J. DÍAZ MÁRQUEZ, actuando en nombre propio y como Presidente de la Caja de Ahorros y Previsión Social de los Trabajadores de la Universidad de Oriente (CAUDO), asistido por el abogado M.S.S., contra el artículo 34 de la Ley de Cajas de Ahorro, Fondos de Ahorro y Asociaciones de Ahorro Similares.
Por cuanto fue promulgada una nueva Ley Orgánica del Tribunal Supremo de Justicia, en la cual se establecen normas procedimentales en su Capítulo II denominado “De los Procesos ante la Sala Constitucional”, este Juzgado de Sustanciación conforme a lo establecido los artículos 135, segundo aparte y 136 de la referida Ley Orgánica, acuerda notificar a la parte demandante, mediante comisión de despacho.
Todo ello, para dar cumplimiento al procedimiento establecido en los artículos 139 y siguientes de la Ley Orgánica del Tribunal Supremo de Justicia.
