JUZGADO VIGÉSIMO PRIMERO DE MUNICIPIO DE LA CIRCUNSCRIPCIÓN
JUDICIAL DEL ÁREA METROPOLITANA DE CARACAS.
Caracas, 04 de Febrero de 2011
Años 200º de la Independencia y 151º de la Federación.
SOLICITANTE: A.A.C.D.E., venezolana, mayor de edad, titular de la cédula de identidad N° V-1.416.810
ABOGADA ASISTENTE: C.I., inscrita en el Inpreabogado bajo el Nº 71.005.
MOTIVO: DECLARACIÓN DE ÚNICOS Y UNIVERSALES HEREDEROS
SOLICITUD: AP31-S-2010-007812
Se inició el presente procedimiento mediante escrito presentado el 22 de Noviembre de 2.010, compareciendo la ciudadana A.A.C.D.E., asistida por la Abogada C.I. , inscrita en el Inpreabogado bajo el Nº 71.005, quien solicitó se le declare Única y Universal Heredera de su esposo.
En la presente solicitud, se pretende que se declare Únicos y Universales Herederos, del ciudadano J.A.E.B. a la solicitante A.A.C.D.E. y a los ciudadanos: ESPINA CHACIN C.V., ESPINA CHACIN S.J.D.E.S. y ESPINA CHACIN J.A.F., sin embargo, luego de una revisión exhaustiva de los recaudos presentados a tales efectos, específicamente del acta de defunción y el acta de nacimiento, se aprecia que existe un error en dichos documentos en relación al nombre de la solicitantes, por cuanto en el escrito se identifica como “ Ana Altamia”, en el Acta de defunción se identifica como “ Ana Altamira” y de las Actas de Nacimiento se identifica como “Ana Altamira” .
En tal sentido y visto que los datos contenidos en el acta de defunción y el acta de nacimiento no coinciden, es forzoso para este Tribunal negar la admisión de la presente solicitud, dado que se hace imposible determinar cual es la identificación correcta de la solicitante, razón por la cual este Juzgado Vigésimo Primero de Municipio de la Circunscripción Judicial del Área Metropolitana de Caracas declara inadmisible la presente solicitud. Así se decide.
