JUZGADO PRIMERO DE PRIMERA INSTANCIA
EN LO CIVIL Y MERCANTIL DE LA CIRCUNSCRIPCIÓN
JUDICIAL DEL ESTADO BARINAS.

En el presente expediente contentivo de la Solicitud COBRO DE BOLIVARES POR INTIMACIÓN, intentado por el abogado en ejercicio R.B.R., inscrito en el inpreabogado bajo el N° 22.252, en su carácter de Endosatario en Procuración de una Letra de Cambio librada a nombre de la ciudadana M.A.P.A., venezolana, mayor de edad, titularde la cédula de identidad N° 3.691.201, en contra de los ciudadanos E.I. BASTARDO ROJAS Y E.I.B.C., venezolanos, mayores de edad, titulares de las cédulas de identidad N°s. 12.203.848 y 2.745.135 respectivamente, ingresó a este Tribunal en fecha 07-06-00, cursa al folio (09) auto de admisión de la demanda de fecha 12-07-00.
Cabe señalar que la acción principal se encuentra paralizada por inactividad procesal del accionante desde el día 12-07-00.
Para decidir la extinción de esta Instancia este Tribunal hace las siguientes consideraciones:
Que las partes no han realizado ninguna actividad procesal en el expediente desde el día 12-07-00.
Que en el caso que nos ocupa considera quien juzga, que no es necesaria la realización de un Computo para determinar si ha trascurrido un año a contar desde la fecha de admisión de la demanda sin haberse ejecutado ningún acto de procedimiento por las partes.
En razón de lo aquí expuesto, es forzoso concluir en que la inactividad procesal de las partes, ha dado lugar a la sanción establecida en el artículo 267 del Código de Procedimiento Civil. Así se Decide.

Dispone el Artículo 269 del Código de Procedimiento Civil:
La perención se verifica de derecho y no es
renunciable por las partes. Puede declarase de
oficio por el Tribunal y la sentencia que la
declare, en cualquiera de los casos del artículo
267, es apelable libremente
