JUZGADO CUARTO SUPERIOR DEL TRABAJO DEL CIRCUITO JUDICIAL DEL TRABAJO DE LA CIRCUNSCRIPCION JUDICIAL DEL AREA METROPOLITANA DE CARACAS
ASUNTO: AP21-R-2012-000117
Vista la diligencia que antecede, de fecha 27 de Abril de 2012, suscrita por el abogado J.R.G.V., inscrito en el Inpreabogado bajo el N° 90.847, actuando en su carácter de apoderado judicial de la parte actora, mediante la cual desiste del recurso de Casación interpuesto contra la decisión de fecha 18 de abril de 2012, dictada por este JUZGADO SUPERIOR, en el juicio que por cobro de diferencia de prestaciones sociales incoara el ciudadano J.M.B.I., contra la empresa LEIRIMETAL LATINOAMERICA, C.A. Y TAECA, C.A., partes identificadas a los autos, este Tribunal encontrándose dentro del lapso legal dispuesto por el artículo 170 de la Ley Orgánica Procesal del Trabajo, habida cuenta del pronunciamiento sobre la negativa de admitir el respectivo Recurso de Casación; por no ser contrario a Derecho lo HOMOLOGA, en consecuencia, le imparte los efectos de cosa juzgada, declara desistido el Recurso de Casación anunciado por la parte actora antes identificada y negado oír por este Tribunal, sin embargo, ordena la remisión del presente expediente a la Sala de Casación Social del Tribunal Supremo de Justicia a los fines legales consiguientes conforme a lo acordado por esta Alzada en auto de fecha 27 de los corrientes, una vez transcurridos los lapsos procesales respectivos.-
Publíquese, regístrese y déjese copia certificada de la presente decisión en el compilador respectivo.
Dada, firmada y sellada en la sala de Despacho del Juzgado Cuarto Superior del Trabajo del Circuito Judicial del Trabajo de la Circunscripción Judicial del Área Metropolitana de Caracas, a los treinta (30) días del mes de Abril de dos mil doce (2012), años 202º de la Independencia y 153º de la Federación.
