Del análisis y revisión de la presente demanda, se observa que en auto de fecha 21-junio-2007, se instó a la parte demandante, abogado B.P.R., inscrito en el Inpreabogado bajo el No. 24.318, actuando en su carácter de apoderado judicial del ciudadano J.C.G.N., a dar cumplimiento a lo establecido en los artículos 340 ordinal 2° y 691 del Código de Procedimiento Civil, y cumplida con estas formalidades el tribunal se pronunciaría en relación con la admisión de la misma.
En tal sentido, se evidencia que desde el 21-junio-2007, hasta la presente fecha la parte demandante no le ha dado cumplimiento a las normas señaladas anteriormente, incumpliendo así con la condición impuesta por este despacho para proceder a la admisión o no de la demanda; es por lo que, este Juzgado Segundo de Primera Instancia en lo Civil, Mercantil, Agrario, Tránsito y Bancario de la Circunscripción Judicial del Estado Carabobo, con sede en Puerto Cabello, en nombre de la República Bolivariana de Venezuela y por autoridad de la ley, declara INADMISIBLE la demanda por Prescripción Adquisitiva, incoada por el abogado B.P.R., actuando en su carácter de apoderado judicial del ciudadano J.C.G.N. contra la ciudadana Inga Steinvorth de Goetz. Y así se decide.
Se ordena la notificación de la parte demandante, conforme a lo establecido en el artículo 233 del Código de Procedimiento Civil, parte infine. Advirtiéndosele que la presente decisión es recurrible mediante recurso ordinario de apelación, dentro del término establecido en el artículo 298 del Código de Procedimiento Civil.
