ASUNTO: KP02-S-2008-009436
Vista la Solicitud presentada por el ciudadano C.A.P., venezolano, mayor de edad, titular de la Cedula de Identidad Nº V.- 12.617.258, asistido en este acto por el Abogado en ejercicio J.V.B., inscrito en el I.P.S.A bajo el N° 92.310, este Tribunal en áreas de conciliar las exigencias y formalidades sancionadas en la Legislación especial de Transito, dirigidas a precaver cualquier irregularidad en las operaciones de traspaso de propiedad de vehiculo y que regalan cuidadosamente el tracto sucesivo de dominio sobre los vehículos automotores concretamente en los dispositivos contenidos en los Artículos 9,11 y 13 de la Vigente Ley de Transito y 107 del Reglamente de la citada Ley y los medios ordinarios de transmisión de la propiedad sancionados en el Código Civil Venezolano Vigente, en consecuencia se advierte que la manera idónea de obtener un procedimiento judicial sobre la propiedad del vehiculo, conforme a los términos planteados en la solicitud debe serlo por la vía contenciosa Mero-declarativa y no por la vía de un justificativo, por lo tanto SE DECLARA INADMISIBLE LA SOLICITUD PRESENTADA y así se decide, en nombre de la Republica Bolivariana de Venezuela y por autoridad de la Ley.-
