Hoy, 26 de septiembre del año 2007 siendo las 2:00 p.m.., día y hora fijado para que tenga lugar la Audiencia Preliminar, se deja constancia que se anunció dicho acto en la sala de comparecencia de los Juzgados con las formalidades de Ley, no compareciendo la parte actora, ni por si, ni por medio de apoderado judicial alguno, en consecuencia, vista la incomparecencia de la parte actora en el presente juicio y de conformidad con lo previsto en el artículo 130 de la Ley Orgánica Procesal del Trabajo, este Juzgado Trigésimo Tercero de Sustanciación, Mediación y Ejecución del Trabajo de la Circunscripción Judicial del Área Metropolitana de Caracas, dicta seguidamente el dispositivo del fallo, así: PRIMERO: SE DECLARA EL DESISTIMIENTO DEL PROCEDIMIENTO HABIDO EN EL JUICIO INCOADO POR C.C. EN CONTRA Republica Bolivariano de Venezuela ( Ministerio del Ambiente y Recursos Naturales Renovables) y así, SE DÁ POR TERMINADO EL PROCESO Y SE DECLARA EXTINGUIDA LA INSTANCIA. ASÍ SE DECIDE.-
