JUZGADO DE LOS MUNICIPIOS AGUA BLANCA Y SAN RAFAEL DE ONOTO DEL SEGUNDO CIRCUITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO PORTUGUESA

EXPEDIENTE 361/2008.-
De la revisión de las actas procesales, esta Juzgadora observa:
“Que de conformidad a la LEY ORGANICA PARA LA PROTECCIÓN DEL NIÑO Y ADOLESCENTE, la obligación de manutención establecida en el artículo 365, comprende todo lo relativo a sustento, vestido, habitación, educación, cultura, asistencia y atención medica, medicinas, recreación y deportes, requeridos por el niño, niña o adolescente.
Ahora bien para determinar la cantidad que le correspondería pagar al obligado por concepto de obligación de manutención, establece la LEY ORGANICA PARA LA PROTECCIÓN DEL NIÑO Y ADOLESCENTE, en su artículo 369 el deber que tiene el Juez, de tomar en cuenta la capacidad económica del obligado, estableciéndose de igual modo que cuando el obligado trabaje sin relación de dependencia, su capacidad económica se establecerá por cualquier medio idóneo.
Teniendo presente que los Jueces deben tener como norte de sus actos, la verdad de conformidad a lo establecido en el artículo 12 del Código de Procedimiento Civil, y tomando en cuenta lo expresado por el procesalista DEVIS ECHANDÍA, quien a expuesto “refutado el viejo concepto privatista del proceso civil, caen por su base los argumentos de quienes desean mantener maniatado al juez ante el debate probatorio. Porque si hay un interés público en que el resultado del proceso civil sea justo y legal, el Estado debe dotar al Juez de poderes para investigar la verdad de los hechos (………….) “
