ASUNTO: AP11-V-2017-000542

Por recibido el presente asunto contentivo de los Daños y Perjuicios que demanda M.A.F.R. contra J.G.O.C., este Tribunal observa del escrito libelar presentado que la parte accionante omitió estimar la cuantía de su pretensión en Unidades Tributarias siendo un requisito indispensable para tramitar la demanda, y, de cara al futuro, eventuales recursos.

Es necesario en esta etapa del proceso invocar la Resolución N° 2009-0006 de fecha 18 e Marzo de 2009, emanada de la Sala Plena del Tribunal Supremo de Justicia, publicada en la Gaceta Oficial No. 39.152 de fecha 02 de abril de 2009; en cuya parte final del artículo 1 estableció:

“…A los efectos de la determinación de la competencia por la cuantía en todos los asuntos contenciosos cuyo valor sea apreciable en dinero, conste o no el valor de la demanda, los justiciables deberán expresar, además de las sumas en bolívares conforme al Código de Procedimiento Civil y demás leyes que regulen la materia su equivalente en Unidades Tributarias (UT) al momento de la interposición del asunto...”. (Resaltado del Tribunal)

De esta manera es deber de quien suscribe considerar que, establecidos los requisitos formales del libelo de la demanda contenidos en el artículo 340 del Código de Procedimiento Civil, aunado a la Resolución antes mencionada, transcrita parcialmente, dicho instrumento adolece de tal formalidad esencial que debe ser corregida y ASI SE ESTABLECE.

En consecuencia de lo anterior, este Juzgado Séptimo de Primera instancia en lo Civil, Mercantil, del Tránsito y Bancario de la Circunscripción Judicial del Área Metropolitana de Caracas, administrando justicia en nombre de la República y por autoridad de la Ley, en ejercicio de la autoridad conferida como director del proceso, y conforme a lo establecido en el artículo 642 del Código de Procedimiento Civil, aplicado en forma analógica, ordena subsanar el libelo de la demanda en los términos que han sido expuestos en el presente auto.

Se establece un lapso perentorio de 30 días continuos para la adecuación del escrito libelar so pena de inadmisión de la demanda.
