MOTIVO: DIFERENCIA SALARIAL
SENTENCIA: INTERLOCUTORIA
Mediante diligencia de fecha 04 de octubre de 2016 (folio 130), ambas partes en el presente juicio, se han avenido en cuanto a los montos realmente adeudados por las horas extras, a cada uno de los trabajadores, desde el año 2008 a 2012. Ahora bien, los salarios devengados por los accionantes, así como los días efectivamente laborados, y la cantidad de horas extras correspondientes a cada uno de ellos, resulta forzoso establecer que los actores tienen derecho al pago de los siguientes montos por horas extras:

3) DAVID PACHECO VARGAS, Bs. 84.439,68.
4) JOSÉ ALVARADO, Bs. 63.721,44.
5) YGNACIO ALEXIS REYES, Bs. 87.431,68.
6) PEDRO QUINTANA, Bs. 77.402,36.
7) PERFECTO ANTONIO TOVAR, Bs. 62.799,36.
8) ANDRES PACHECO, Bs. 64.780,88.
9) FRANCISCO RIVAS, Bs. 70.244,00.
10) DARWIN LÓPEZ, Bs. 84.376,44.
11) JESUS ENRIQUE SANTELIZ, Bs. 92.501,76.
12) FELIX ULLOA, Bs. 66.744,72.
13) AMBROSIO ARGUINZONES, Bs. 91.624,56.

Los montos antes especificados, son los que el Juzgado Tercero (3°) Superior del Trabajo de esta misma Circunscripción Judicial en fecha 14/01/2016, ordenó a la demandada a cancelar a cada uno de los actores, los cuales se ajustan a lo dispuesto en el articulo 38, 182 y 183 de la Ley Orgánica del Trabajo, del 01 de mayo de 1991, reformada de manera parcial el 19 de junio de 1997, publicada en Gaceta Oficial de la República de Venezuela Nº 5.152, Extraordinaria, a su vez reformada el 06 de mayo de 2011, publicada en Gaceta Oficial Nº 6.204, Extraordinaria así como a lo dispuesto en el articulo 175, 190 y 198 de la Ley Orgánica del Trabajo, las Trabajadoras y Trabajadores pues entró en vigencia el día 07 de mayo de 2012, cuando fue publicada en Gaceta Oficial Nº 6.076, Extraordinaria.
Finalmente se ordena que el cálculo de los intereses moratorios y la indexación monetaria de los montos condenados precedentemente, se computarán desde la fecha de notificación de la parte demandada, es decir, desde el 05-06-14 ( folio 26) hasta que la presente decisión quede definitivamente firme, excluyendo de dicho cálculo los lapsos sobre los cuales la causa se haya paralizado por acuerdo entre las partes, por hechos fortuitos o de fuerza mayor, tales como suspensión por mutuo acuerdo, vacaciones judiciales y similares. En caso de no cumplimiento voluntario de la sentencia el Juez de Sustanciación, Mediación y Ejecución del Trabajo competente, aplicará lo preceptuado en el artículo 185 de la Ley Orgánica Procesal del Trabajo. Tales cálculos deberán ser realizados por el Juez de Sustanciación, Mediación y Ejecución. En razón de ello pasa este Juzgado a establecer los montos condenados indexados y con los intereses moratorios a continuación:
