Visto escrito de transacción consignado a los autos, en fecha trece (13) de diciembre de 2017 por las partes, ciudadanos: la parte Demandante ciudadano J.X.M.J., cédula de identidad N°V-19.829.485, su apoderado judicial, abogado J.G.F., inscrito en el INPREABOGADO bajo el N°95.909, acreditación que consta en autos y por la parte Demandada OPERADORA DLV 001, C.A., sociedad mercantil inscrita en el Registro Mercantil V de la Circunscripción Judicial del Distrito Capital y Estado Miranda, bajo el N°31, Tomo 269-A-qto, en fecha 14 de diciembre de 2016, su apoderado judicial, abogado NAUDY M.D., inscrito en el INPREABOGADO bajo el Nº48.780, acreditación que consta en autos; este Juzgado Vigésimo Sexto (26°) de Primera Instancia de Sustanciación, Mediación y Ejecución del Circuito Judicial del Trabajo del Área Metropolitana de Caracas, conociendo en fase de Mediación, le imparte la HOMOLOGACION a dicho acuerdo, cuyo monto total fue por BOLÍVARES UN MILLÓN CUATROCIENTOS TREINTA Y NUEVE MIL CIENTO CINCUENTA Y CINCO CON NOVENTA Y TRES CÉNTIMOS (Bs.1.439.155,93); y comprende los conceptos explanados en el escrito libelar, es decir, antigüedad o garantía de prestación, indemnización por despido; utilidades fraccionadas, vacaciones fraccionadas, bono vacacional fraccionado, beneficio de alimentación reclamado e intereses sobre prestaciones sociales; de conformidad con el artículo 89, numeral 2º de la Constitución de la República Bolivariana de Venezuela, en concordancia con el artículo 19 del Decreto con Rango, Valor y Fuerza de Ley Orgánica del Trabajo, los Trabajadores y las Trabajadoras y no menos importante el artículo 10 del Reglamento de la Ley Orgánica del Trabajo. En este sentido, una vez precluya el lapso de impugnación de la presente decisión, se ordenará: 1º dar por terminado el presente expediente. Asimismo, este Tribunal advierte que si bien la representación judicial de la parte Demandada no suscribió el folio 46 del físico del expediente, que vincula a la transacción, se observa que al folio 43, en el comprobante de recepción emanado de la URDD de este Circuito Judicial del Trabajo, inherente a la entrega del contrato de transacción, se evidencia la rúbrica del profesional del derecho; 2º se ordena dejar en el copiador de sentencias interlocutorias con fuerza de definitiva, que lleva este Tribunal, copia certificada de la presente decisión; y 3° su consecuente remisión al archivo judicial. Igualmente, Finalmente, se ordena notificar mediante boleta a las partes, de la presente decisión. Líbrense boletas de notificación. Así se establece.-
