Visto el escrito presentado por el Abog. J.D.P., en su carácter de Fiscal Auxiliar Vigésimo del Ministerio Público de la Circunscripción Judicial del Estado Anzoátegui, en el cual solicita la Desestimación de la Denuncia interpuesta por la ciudadana NANYLUIS DEL VALLE GUTIERREZ, titular de la cedula de identidad Nº V- 18.766.621, de conformidad con lo previsto en el artículo 283 del Código Orgánico Procesal Penal, este Tribunal a los fines de decidir, previamente observa y considera:

En fecha 27-05-2009, se recibió por ante esa Fiscalía Denuncia Común interpuesta NANYLUIS DEL VALLE GUTIERREZ, titular de la cedula de identidad Nº V- 18.766.621, la cual cursa al folio 02 y su vto contra C.L. RAMONIS Y G.J.R., porque ambos le lanzaron piedras a la casa, dañando la puerta y parte del techo...…/es todo.-

Así las cosas, el artículo 283 del Código Orgánico Procesal Penal, establecen lo siguiente:

“El Ministerio Publico, dentro de los quince días siguientes a la recepción de la denuncia o querella, solicitara al Juez de control, mediante escrito motivado, su desestimación, cuando el hecho no revista carácter penal o cuya acción esta evidentemente prescrita, o exista un obstáculo legal para el desarrollo del proceso.

Se procederá conforme a lo dispuesto en este articulo, si luego de iniciada la investigación se determinare que los hechos objetos del proceso constituyen delito cuyo enjuiciamiento solo procede a instancia de parte agraviada.”

Ahora bien, a los efectos arriba mencionados y del análisis realizado a las presentes actuaciones, se evidencia que los hechos objeto del proceso es enjuiciable a instancia de parte agraviada como lo es el delito de DAÑOS MATERIALES, previsto en el articulo 473 del Código Penal vigente para la fecha de la ocurrencia de los hechos antes mencionados, que NO REVISTEN CARÁCTER PENAL, considerando quien aquí suscribe que lo procedente y ajustado a derecho es DECRETAR LA DESESTIMACION DE LA DENUNCIA, ello conforme a lo establecido en el articulo 283 del Código Orgánico Procesal Penal, acogiéndose de esta manera la opinión del titular de la acción penal, es decir el Represente del Ministerio Publico. Y ASI SE DECLARA.

DISPOSITIVA

Por todos los razonamientos antes expuestos, este Juzgado Cuarto de Primera Instancia en Funciones de Control del Circuito Judicial Penal de la Circunscripción Judicial del Estado Anzoátegui, Administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, DECRETA LA DESESTIMACION DE LA DENUNCIA, interpuesta por la ciudadana NANYLUIS DEL VALLE GUTIERREZ, titular de la cedula de identidad Nº V- 18.766.621, en contra de los ciudadanos C.L. RAMONIS Y G.J.R., todo ello conforme a lo establecido en el articulo 283 del Código Orgánico Procesal Penal.
Regístrese, diarícese, notifíquese y remítase el presente expediente en su oportunidad a la Fiscalía 20° del Ministerio Público de la Circunscripción Judicial del Estado Anzoátegui.
