Resumen:En mérito de las razones expuestas, esta Sala Tercera de la Corte de Apelaciones del Circuito Judicial Penal del estado Zulia, Administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, Declara: PRIMERO: SIN LUGAR el recurso de apelación presentado por la profesional del derecho M.O.M., Defensora Pública Tercera Penal Ordinario e Indígena, actuando en su carácter de defensora del ciudadano C.A.R.S.. SEGUNDO: CONFIRMA la decisión Nro. 358-2016, de fecha 14 de marzo de 2016, dictada por el Juzgado Primero de Primera Instancia en Funciones de Control del Circuito Judicial Penal del estado Zulia, extensión R.d.P., mediante la cual, en la audiencia de presentación de imputado entre otros pronunciamientos, decretó: PRIMERO: Declaró legítima la APREHENSIÓN EN FLAGRANCIA del imputado C.A.R.S., plenamente identificado, de conformidad con lo previsto en el artículo 234 del Código Orgán.....
