DECISION No. 7C-S-2230-11 RESOLUCION No. 385-14
Vista la solicitud presentada por el ciudadano D.P.M., titular de la cedula de identidad No. 16.607.347, en la cual solicita sea autorice al ciudadano DIURIS R.L.F., titular de la cedula de identidad No. v.- 14.560.355, para conducir el vehículo: MARCA: MAZDA, MODELO: MAZDA 6, TIPO: SEDAN, COLOR: GRIS, PLACA: ESM CLASE: AIJTOMOVIL, SERIAL DE CARROCERIA: 9FCGG453260005395, SERIAL DEL MOTOR: L3427808; este Tribunal considera necesario señalar lo siguiente:
Se evidencia de las actas que en fecha 30 de Agosto de 2013, este Tribunal mediante decisión no. 1202-13, acordó hacer entrega bajo la modalidad de uso, guarda y custodia del vehículo MARCA: MAZDA, MODELO: MAZDA 6, TIPO: SEDAN, COLOR: GRIS, PLACA: ESM CLASE: AIJTOMOVIL, SERIAL DE CARROCERIA: 9FCGG453260005395, SERIAL DEL MOTOR: L3427808, al ciudadano D.P.M., titular de la cedula de identidad No. 16.607.347, imponiendo al mismo de las siguientes obligaciones: 1.- Prohibido conducirlo personas distintas al ciudadano antes identificado; 2.- Prohibido venderlo, enajenarlo, arrendarlo, sub-arrendarlo y/o realizar cualquier acto jurídico que conlleve el traspaso temporal o definitivo del vehículo de actas, 3.- Cuidarlo como un Buen Padre de Familia, en el sentido de tramitar ante los organismos correspondientes el trámite de ley para resolver la situación referente al mismo, y 4.- Presentar el vehículo de actas cada seis (06) meses o al Ministerio Público cuando sea necesario y requerido por el órgano instructor o por un tribunal de justicia previa notificación.-
En tal sentido, habiéndose acordado la entrega del mencionado vehículo al ciudadano ut supra indicado y como quiera que el mismo ha solicitado a este digno despacho se autorice al ciudadano DIURIS R.L.F., titular de la cedula de identidad No. v.- 14.560.355, con el objeto de poder conducir el referido vehículo, por cuanto el mencionado bien es utilizado para coadyuvar el sustento del hogar del hoy solicitante y de esta forma realizar el transporte hasta distintos sector de la población en la cual reside, lo cual es dificultoso por las actividades laborales del mismo, todo lo cual hace imposible el cumplimiento de una de las obligaciones impuestas.
Dada las consideraciones que anteceden, siendo que los ciudadanos están suficientemente capacitados para conducir el vehículo objeto del presente proceso, es por lo cual considera este Juzgador procedente en derecho AUTORIZAR al ciudadano DIURIS R.L.F., titular de la cedula de identidad No. v.- 14.560.355 a conducir el Vehículo MARCA: MAZDA, MODELO: MAZDA 6, TIPO: SEDAN, COLOR: GRIS, PLACA: ESM CLASE: AIJTOMOVIL, SERIAL DE CARROCERIA: 9FCGG453260005395, SERIAL DEL MOTOR: L3427808, el cual fue entregado en calidad de uso, guarda y custodia exclusivamente al ciudadano D.P.M., titular de la cedula de identidad No. 16.607.347, todo de conformidad con lo establecido en los Artículos 293 y 294 del Código Orgánico Procesal Penal. Y ASI SE DECIDE.
DISPOSITIVA
Por lo anteriormente expuesto este Juzgado Séptimo de Control del Circuito Judicial Penal Fronterizo del Estado Zulia, Administrando Justicia, en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley resuelve: AUTORIZAR al ciudadano DIURIS R.L.F., titular de la cedula de identidad No. v.- 14.560.355 a conducir el Vehículo MARCA: MAZDA, MODELO: MAZDA 6, TIPO: SEDAN, COLOR: GRIS, PLACA: ESM CLASE: AIJTOMOVIL, SERIAL DE CARROCERIA: 9FCGG453260005395, SERIAL DEL MOTOR: L3427808, el cual fue entregado en calidad de uso, guarda y custodia exclusivamente al ciudadano D.P.M., titular de la cedula de identidad No. 16.607.347, de conformidad a lo dispuesto en los artículos 293 y 294 del Código Orgánico Procesal Penal. Se acuerda expedir autorización a nombre de los ciudadanos aquí autorizados. REGÍSTRESE Y NOTIFÍQUESE-
