Vista la solicitud de Sobreseimiento de la causa consignada por la Fiscalía Tercera del Ministerio Público de esta Circunscripción Judicial, conforme a los artículos 108, ordinal 7° del Código Orgánico Procesal Penal, 34, ordinal 10° de la Ley Orgánica del Ministerio Público, 318, ordinal 3°, 48, ordinal 8° del Código Orgánico Procesal Penal y 108, ordinal 4° del reformado Código Penal, en el proceso incoado en contra de PERSONAS DESCONOCIDAS, por la comisión del delito de HURTO AGRAVADO, penado en el artículo 454, ORDINAL 8° del derogado Código Penal, cometido en perjuicio de TENIS R.V.R.; este Tribunal, para decidir al respecto, observa:
Los hechos que nos ocupan se suceden el 05/07/00 y tratándose del delito de HURTO AGRAVADO, penado en el artículo 454, ordinal 8° del reformado Código Penal y con un lapso de prescripción de cinco (5) años, de acuerdo a lo dispuesto en el ordinal 4° del artículo 108 Ejusdem, y en virtud de haber transcurrido un lapso de más de cinco (05) años, desde la fecha en que se perpetrara el ilícito penal perseguido, sobrepasando en exceso el lapso de prescripción aplicable, se debe concluir que la petición Fiscal se encuentra ajustada a Derecho y se procede en consecuencia a decretar el SOBRESEIMIENTO DE LA PRESENTE CAUSA, por haber operado la prescripción de la acción penal, de acuerdo a los artículos 318, ordinal 3°, 48, ordinal 8° del Código Orgánico Procesal Penal, en relación con el artículo 108, ordinal 4° del reformado Código Penal y así se decide.-
DISPOSITIVA
Este Tribunal de Primera Instancia en Función Cuarto de Control del Circuito Judicial del Estado Anzoátegui, Administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, DECLARA CON LUGAR la solicitud de SOBRESEIMIENTO DE LA CAUSA, presentada por la parte Fiscal, en la causa incoada en contra de PERSONAS DESCONOCIDAS, por la comisión del delito de HURTO AGRAVADO, cometido en perjuicio de TENIS R.V.R.; de acuerdo a los artículos 318, ordinal 3° y 48, ordinal 8° del Código Orgánico Procesal Penal, en concordancia con el artículo 108, ordinal 4° del reformado Código Penal.
