Corresponde a esta Alzada decidir sobre la admisibilidad de la pretensión interpuesta el 2-12-2013 por el Abg. E.D.V., Fiscal 1º del Ministerio Público de la Circunscripción Judicial del Estado Apure, contra la decisión mediante la cual el 20-11-2013, la Juez 3ª de Primera Instancia en funciones de Control del Circuito Judicial Penal de la Circunscripción Judicial del Estado Apure, Abg. YSMAIRA CAMEJO, de conformidad con el artículo 284 del Código Orgánico Procesal Penal, rechazó la solicitud que hiciera el 19-11-2013 de conformidad con el artículo 283 del Código Orgánico Procesal Penal, para que se desestimara denuncia formulada el 11-11-2013 por el ciudadano N.O.P., ante el Cuerpo de Investigaciones Científicas, Penales y Criminalísticas. La Corte pasa a pronunciarse en los siguientes términos:
Por no configurarse ninguno de los supuestos de inadmisibilidad establecidos en el artículo 428 del Código Orgánico Procesal Penal, se admite la pretensión de conformidad con el numeral 5 del artículo 439 eiusdem.
Este Tribunal Superior se reserva el lapso establecido en el primer aparte del artículo 442 de la ley adjetiva penal, para resolver la cuestión planteada.
