Vista la diligencia de fecha catorce (14) de Abril de 2009, suscrita por la ciudadana D.L.I.D.P., titular de la cédula de identidad N° V- 6.356.277, parte demandante en el presente procedimiento, debidamente asistida por el abogado A.L., inscrito en el Inpreabogado bajo el N° 33.486, mediante la cual manifiesta su voluntad de desistir del procedimiento incoado en contra de la CAJA DE AHORRO DEL PODER JUDICIAL (CAPOJUD) C.A, por Calificación de Despido, y por cuanto se observa que la actuación realizada es producto de la voluntad libre, consciente y espontánea expresada por la parte actora; la cual no es contraria a derecho, al orden público, ni a las buenas costumbres; en consecuencia este Tribunal Cuarto de Primera Instancia de Sustanciación, Mediación y Ejecución del Trabajo del Circuito Judicial del Área Metropolitana de Caracas, en uso de sus atribuciones legales previstas en los artículos 261 y 262, del Código de Procedimiento Civil y en el Artículo 3 Parágrafo Único de la Ley Orgánica del Trabajo, HOMOLOGA el presente desistimiento y le otorga fuerza de COSA JUZGADA, ya que es Ley entre las partes. En al sentido, se da por terminado el procedimiento ordenando su cierre y archivo y cierre informático. CUMPLASE.
