AUTO REMITIENDO LAS ACTUACIONES AL ARCHIVO JUDICIAL POR SENTENCIA ABSOLUTORIA
Revisada la presente causa, se observa de la sentencia dictada por el Tribunal Primero de Juicio del Circuito Judicial del Estado Bolívar, en fecha: 17/04/2007, mediante la cual dictó Sentencia por SOBRESEIMIENTO a favor del ciudadano: E.E.M., titular de la Cédula de identidad N° 17.656.649, por el delito de: PORTE ILICITO DE ARMA DE FUEGO, previsto y sancionado en el artículo 278 del Código Penal Venezolano, por el cual acusó el Ministerio Público, en su debida oportunidad. En consecuencia, este Tribunal Primero de Ejecución de Sentencia del Circuito Judicial Penal del Estado Bolívar, Administrando Justicia en Nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, ORDENA EL ARCHIVO DE LAS ACTUACIONES, por cuanto se decreto el Sobreseimiento de la Causa, a favor de: E.E.M., titular de la Cédula de identidad N° 17.656.649, todo ello, de conformidad con el Artículo 318 Ordinal 3º primer supuesto del Código Orgánico Procesal Penal. Notifíquese a las partes, ofíciese al Comisario Jefe de la Sub-Delegación Ciudad Bolívar, a objeto de que proceda a excluir del Sistema Integrado de Información Policial (SIIPOL) al penado de marras, en lo atinente a la Causa signada bajo la Nomenclatura llevada por ese Despacho, con el Nº G-562.901, y en su oportunidad legal remítase la presente causa al Archivo Judicial, a los fines de su guarda y custodia. Cúmplase.
