EL JUZGADO SUPERIOR EN LO CIVIL Y CONTENCIOSO ADMINISTRATIVO DE LA CIRCUNSCRIPCION JUDICIAL DE LA REGION CENTRO NORTE.-

Vista la decisión dictada por el Juzgado Segundo de Primera Instancia de Mediación y Sustanciación de Protección de Niños, Niñas y Adolescentes del Estado Cojedes, este Tribunal acepta la competencia que le ha sido declinada.
En consecuencia, vista la diligencia presentada el 30 noviembre 2009 por la ciudadana E.C.C.C., cédula de identidad V-8.741.009, asistida por la abogada C.M., Inpreabogado Nº 62.001, mediante el cual expone “DESISTO de la causa signada con el Nº 12.884 de la nomenclatura de este Tribunal” contentiva del recurso de nulidad (Materia Funcionarial)” interpuesto contra el INSTITUTO AUTÓNOMO CONSEJO NACIONAL DE DERECHOS DE NIÑOS, NIÑAS Y ADOLESCENTES DEL MUNICIPIO SAN CARLOS, ESTADO COJEDES; este Juzgador observa que el desistimiento no es contrario al orden público, a la moral, buenas costumbres ni disposición expresa de la ley que impida su homologación, en razón de lo cual este Juzgado impartiendo justicia en nombre de la República Bolivariana de Venezuela por autoridad de la Ley declara Homologado el desistimiento realizado por la ciudadana E.C.C.C., parte querellante.
