REPÚBLICA BOLIVARIANA DE VENEZUELA
JUZGADO PRIMERO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL Y DEL T.D.L.C.J.
DEL ÁREA METROPOLITANA DE CARACAS.
Caracas, de julio de 2008.-
Años 198o y 149o.-
Por recibida y vista la anterior solicitud de SEPARACION DE CUERPOS, formulada por los ciudadanos E.D.T.J. y E.N.E.R.F., venezolanos, mayores de edad, conyuges entre sí, de este domicilio y titulares de las Cédulas de Identidad Nos. V-16.670.753 y V-14.876.548, respectivamente; asistidos por la abogada S.O.B.S., inscrita en el Inpreabogado bajo el número 98.422, Defensora Delegada de la Defensoría Nacional de los Derechos de la Mujer (Inamujer). Desele entrada y admitase cuanto ha lugar en derecho; asimismo, visto que este Tribunal los exhortó a la reconciliación sin lograrse ésta, es por lo que, este Juzgado Primero de Primera Instancia en lo Civil, Mercantil y del T.d.l.C.J. del Area Metropolitana de Caracas, administrando Justicia en nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, decreta la SEPARACION DE CUERPOS Y BIENES, en los mismos términos y condiciones por ellos expuestos, por no ser contrarias al orden público o las buenas costumbres, de conformidad con lo establecido en los artículos 189 y 190 del Código Civil, en concordancia con el 762 del Código de Procedimiento Civil.
Asimismo se ordena expedir dos (2) juegos de copias certificadas de la solicitud y del presente auto de conformidad con lo establecido en el artículo 111 y 112 del Código de Procedimiento Civil.-
