ACTA DE INHIBICION
En el día de hoy Quince(15) de Enero del Dos Mil Nueve, presente la Juez Temporal del Juzgado Tercero de Primera Instancia en lo Civil, Mercantil, Agrario y del Tránsito de la Circunscripción Judicial del Estado Falcón, abogado C.L. HANSEN FANEITE, venezolana, mayor de edad, titular de la cédula de identidad N° 12.736.460, domiciliada en esta Ciudad de S.A.d.C., Municipio M.d.E.F., así como la Secretaria Titular del Tribunal abogado D.C., venezolana, mayor de edad, titular de la cédula de identidad N° 10.071.539, y el Alguacil del Tribunal, ciudadano EXCIO AGUILLON, venezolana, mayor de edad, titular de la cédula de identidad N° 10.708.497, la primera de los nombrados expone: “ Me inhibo de conocer la presente causa intentada por el ciudadano J.R.R.R., ESGALDO T.R.R. y G.G.R.D.A., contra E.R.R., M.C.R.R. y D.R.D.Z., por PARTICION DE BIENES, por encontrarme incursa en la causal de inhibición contenida en el ordinal 3 artículo 82 del Código de Procedimiento Civil. En razón del evidente y manifiesto vinculo afectivo de carácter familiar con el abogado DEULIN L.F.A., quién funge como representante legal de las partes demandadas, y enmarcado perfectamente en el parentesco de consanguinidad que pudiese influir en el razonamiento y capacidad subjetiva a la hora de omitir algún procedimiento en el presente juicio, es por lo que en consecuencia, de conformidad con lo establecido en el artículo 82 ordinal 3 del Código de Procedimiento Civil, y en razón de los fundamentos de hecho y de derecho ya esgrimidos es por lo que solicito sea declarada CON LUGAR la presente incidencia. Todo ello a los fines de garantizar el alcance de una recta tutela jurídica efectiva.
