ASUNTO: AP21-L-2008-004553
Visto el escrito de pruebas (folio 114), presentado por el abogado H.T., en su condición de apoderado judicial (folios 103–108 inclusive) de la accionada, este Tribunal a los fines de providenciar lo conducente, lo hace sobre la base de las siguientes consideraciones:
ÚNICO: En referencia al Capítulo «I», el Tribunal destaca a la promovente que la «COMUNIDAD DE LA PRUEBA» no constituye medio de prueba susceptible de promoción sino la expresión de los principios de adquisición o comunidad de los elementos probatorios, los cuales una vez cursan en autos, se hacen del proceso con absoluta independencia de la parte que los produjo.
Por último, se hace saber a las partes que deberán comparecer a la audiencia de juicio tanto el demandante como los órganos directivos y gerenciales de la accionada que tengan conocimiento preciso sobre lo demandado, quienes se consideran juramentadas conforme al artículo 103 de la Ley Orgánica Procesal del Trabajo, para contestar al Juez de Juicio las preguntas que éste tenga a bien formularles.
