Vista la diligencia presentada el 02 de diciembre de 2009 por el abogado LEON A.J.L., titular de la cédula de identidad V-16.448.268, Inpreabogado Nº 122.100, en su carácter de apoderado judicial de los ciudadanos GIANNE ALBERTO PIRONE RODRIGUEZ, F.A. PIRONE RODRIGUEZ, EDDI EDECSO PIRONE BURGOS, G.A.P.B. y FURIO A.P.B., cédulas de identidad V-10.207.122, V-7.673.359, V-11.248.562, V-10.207.774 y V-7.858.766, respectivamente, parte querellante, mediante la cual desiste de la acción por desalojo interpuesta contra la ALCALDÍA DEL MUNICIPIO AUTÓNOMO J.J.M.D.E.C.; este Juzgador observa que el desistimiento no es contrario al orden público, a la moral, buenas costumbres ni disposición expresa de la ley que impida su homologación, en razón de lo cual este Juzgado impartiendo justicia en nombre de la República Bolivariana de Venezuela por autoridad de la ley declara Homologado el desistimiento realizado por la parte querellante.
