Vista la solicitud de sobreseimiento que presentó por ante este Tribunal de Control interpuesta por GUEVARA BLANCA a favor de IDENTIDAD OMITIDA conforme al artículo 325 numeral 4º del Código Orgánico Procesal Penal, a quien se le imputaba la comisión del delito , y a quien según el criterio del fiscal, no se le puede atribuir en consecuencia la comisión del referido delito ut supra calificado, ya que de las investigaciones practicadas no emergen bases suficientes para solicitar el enjuiciamiento de laguna persona, y menos al referido imputado de autos.
A.c.h.s.p. este tribunal la presente solicitud de sobreseimiento, se encuentra procedente y ajustada a derecho la solicitud de sobreseimiento de la parte fiscal a favor del ciudadano IDENTIDAD OMITIDA, fundamentada en el numeral 4º del artículo 325 del Código Orgánico Procesal Penal. Así se decide.
Por todos los razonamientos anteriormente expuestos, este Tribunal de Control del Circuito Judicial Penal de la Circunscripción Judicial del Estado Lara, administrando Justicia en nombre de la República y por autoridad de la Ley DECRETA EL SOBRESEIMIENTO de la causa a favor del ciudadano IDENTIDAD OMITIDA, de conformidad con lo establecido en el numeral 4º del artículo 325 del Código Orgánico Procesal Penal.
Publíquese, Regístrese y Notifíquese a las partes.
