REPÚBLICA BOLIVARIANA DE VENEZUELA
JUZGADO SUPERIOR SEGUNDO EN LO CIVIL Y CONTENCIOSO ADMINISTRATIVO DE LA CIRCUNSCRIPCIÓN JUDICIAL DE LA REGIÓN CAPITAL. Caracas, diecinueve (19) de junio de dos mil catorce (2014).

Visto el escrito de promoción de pruebas presentado por el abogados EUDO S. A.M., inscrito en el Inpreabogado bajo el Nº 52.170, actuando en su condición de apoderado judicial de la Sociedad Mercantil INVERSIONES EL MARENGO C.A. y siendo la oportunidad para su admisión, el Tribunal observa:
Que de conformidad con lo establecido en el artículo 398 del Código de Procedimiento Civil, las pruebas serán inadmitidas cuando sean manifiestamente ilegales e impertinentes.
En relación con las documentales promovidas por la parte recurrente en su escrito de pruebas, marcadas Anexos “F1”, “F2”, “F3” y “F4”, se admiten cuanto ha lugar en derecho, salvo su apreciación en la definitiva, por no ser las mismas manifiestamente ilegales ni impertinentes, de conformidad con lo previsto en el artículo 429 y siguientes del Código de Procedimiento Civil, asimismo en lo que respecta a las documentales marcadas Anexos “B”, “C”, “D” y “E”, del mencionado escrito, las cuales se encuentran agregadas en el escrito libelar este Juzgado señala que las mismas no son objeto de promoción, toda vez que el Juez está obligado de conformidad con lo establecido en el artículo 12 del Código de Procedimiento Civil, a a.t.l.a.y. probado en autos, sin poder sacar elementos de convicción fuera de éstos.
