REPÚBLICA BOLIVARIANA DE VENEZUELA
EN SU NOMBRE
JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL, DEL
TRÁNSITO Y AGRARIO DEL PRIMER CIRCUITO DE LA CIRCUNSCRIPCIÓN
JUDICIAL DEL ESTADO PORTUGUESA- GUANARE.-
Guanare, 16 de octubre de 2.007.
Años 197° y 148°.
Vista la solicitud formulada por el ciudadano J.F.V.M., venezolano, mayor de edad, titular de la cedula de identidad Nº 2.268.050, asistido por las Abogadas MARIFE VALERA GRATEROL y A.J.D.N., inscritas en el Inpreabogado bajo el Nº 79.147 y 8.878, désele entrada y anótese en el libro de solicitudes bajo el Nº 1315-07-C; Este Tribunal a los fines de proveer observa: de la revisión efectuada a la presente solicitud de Justificativo Judicial, se evidencia que la misma es planteada en virtud al cambio de características del vehiculo, como lo es el cambio de motor, no obstante, los supuestos contemplados en el Articulo 94 del Reglamento de la Ley de Transito y Transporte Terrestre son de otra naturaleza; razón por la cual este Tribunal declara INADMISIBLE la presente solicitud, por cuanto el fundamento de hecho alegado no se subsume en la norma jurídica invocada. Así se declara.-
Por todos los razonamientos precedentemente expuestos, este JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL, DEL TRANSITO Y AGRARIO DEL PRIMER CIRCUITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO PORTUGUESA, administrando Justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, declara INADMISIBLE la solicitud presentada por el ciudadano J.F.V.M.. Así se decide.-
Publíquese, regístrese y déjese copia certificada.
Déjese correr el lapso de Ley correspondiente.
Dada, sellada y firmada en la Sala del JUZGADO SEGUNDO DE PRIMERA INSTANCIA EN LO CIVIL, MERCANTIL, DEL TRÁNSITO Y AGRARIO DEL PRIMER CIRCUITO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO PORTUGUESA.
