Resumen:DECISIÓN En consecuencia, este Tribunal Superior en lo Civil y Contencioso Administrativo de la Región Centro Occidental, Administrando Justicia, actuando en nombre de la República Bolivariana de Venezuela y por autoridad de la ley, declara: PRIMERO: Su INCOMPETENCIA para conocer y decidir el recurso de apelación ejercido por la parte demandante, contra la decisión de fecha 05 de junio de 2015, a través del cual el Juzgado Primero de Municipio Ordinario y Ejecutor de Medidas del Municipio Iribarren de la Circunscripción Judicial del Estado Lara, mediante el cual declaro sin lugar la Cuestión Previa de Prejudicialidad y con lugar la demanda de Desalojo interpuesta. SEGUNDO: se DECLINA LA COMPETENCIA ante uno de los Tribunales Superiores con competencia en materia mercantil de la Circunscripción Judicial del Estado Lara.
