Vistas las anteriores actuaciones y la diligencia suscrita en fecha 03 de marzo del año en curso, por el ciudadano J.R.M., venezolano, mayor de edad, titular de la cédula de identidad Nro. 1.603.456, asistido por el abogado en ejercicio A.J.C.G., inscrito en el Inpreabogado bajo el Nro. 50.983, mediante la cual consigna copia certificada del acta de defunción de la de-cujus M.L.M.d.M., quien era venezolana, mayor de edad, titular de la cédula de identidad Nro. 4.465.602, fallecida abintestato en fecha 23/02/2009, tal y como se evidencia de la referida acta de defunción asentada por ante la Prefectura de la Parroquia Catedral del Municipio Barinas del Estado Barinas, bajo el Nro. 23 de fecha 25/02/2009, y por cuanto la muerte de uno de los cónyuges disuelve todo matrimonio válido, con fundamento en el artículo 184 del Código Civil, es por lo que resulta forzoso declarar terminada la presente causa. En consecuencia, se ordena la devolución de los originales solicitados, previa su certificación en autos, insertándose al pie de los documentos que se devolverán copia certificada del presente auto, de conformidad con lo dispuesto en el artículo 112 del Código de Procedimiento Civil. Para la elaboración de la mencionada copia se autoriza suficientemente al Alguacil de este Tribunal, ciudadano J.C.T.M., titular de la cédula de identidad Nro. 13.947.103.
