JUZGADO SEGUNDO DE LOS MUNICIPIOS MARACAIBO, J.E. LOSSADA Y SAN FRANCISCO DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO ZULIA. Maracaibo, 12 de enero de 2011. Años 200º y 151º.- En virtud de que mediante auto dictado en fecha diecinueve (19) de noviembre de 2010, se inició el procedimiento de ejecución de sentencia, al declararse en estado de ejecución voluntaria la sentencia definitivamente firme dictada en fecha diecisiete (17) de septiembre de 2010, este Tribunal prevé que en la misma se ordenó la realización de una experticia complementaria del fallo, de conformidad con el artículo 249 del Código de Procedimiento Civil, y que hasta la fecha no ha sido realizada en la presente causa. En este sentido, en sentencia de la Sala de Casación Civil de la extinta Corte Suprema de Justicia, de fecha veintiséis (26) de mayo de 1994, con Ponencia del Magistrado Aníbal Rueda, se estableció:
…la potestad revocatoria por contrario imperio está consagrada en el artículo 310 del Código de Procedimiento……sólo son revocables por contrario imperio los autos de mera sustanciación o de mero trámite, que son aquellos que tienen por finalidad impulsar y ordenar el proceso, sin proveer sobre el fondo de la controversia…
De igual manera, en sentencia número 00-0211, de la Sala de Casación Civil del Tribunal Supremo de Justicia, de fecha primero (1°) de junio de 2000, con Ponencia del Magistrado Carlos Oberto Vélez, se dispuso:
…Los llamados autos de sustanciación o de mero trámite según el pacifico criterio de la jurisprudencia, no están sujetos a apelación, se trata de providencias que impulsan y ordenan el proceso y por ello no causan lesión o gravamen de carácter material o jurídico a las partes, al no decidir puntos en controversia…
En consecuencia, este Juzgado en uso de la potestad revocatoria dispuesta en el artículo 310 del Código de Procedimiento Civil, y en virtud de que el auto de fecha diecinueve (19) de noviembre de 2010, constituye una providencia de mero trámite y sustanciación del proceso en su fase de ejecución, procede a revocarlo, y de conformidad con el artículo 249 del Código de Procedimiento Civil, ordena oficiar al Banco Central de Venezuela, a fin de que realice la experticia complementaria del fallo ordenada en la sentencia definitivamente firme dictada en la presente causa, contentiva de la corrección monetaria de las cantidades de dinero condenadas a pagar.
