Presentada la solicitud de ÚNICOS Y UNIVERSALES HEREDEROS, suscrita por la ciudadana: L.V.V.E., venezolana, mayor de edad, titular de la cedula de identidad No. V-11.253.197, domiciliada en el Municipio Lagunillas del Estado Zulia, actuando en nombre y representación de su menor hijo (SE OMITE SU NOMBRE, DE CONFORMIDAD CON LO ESTABLECIDO EN EL ARTICULO 65 DE LA LEY ORGÁNICA PARA LA PROTECCIÓN DEL NIÑO Y DEL ADOLESCENTE), y de igual domicilio, asistida por la Abogada en ejercicio YEJEXI ROMERO, inscrita en el inpreabogado bajo el Nº 118.147, désele entrada, numérese y anótese en los libros respectivos. Se admite cuanto ha lugar en derecho por no ser contraria al orden público, a las buenas costumbres y a ninguna disposición expresa de la Ley. En el escrito presentado, la solicitante expuso lo siguiente: “El día siete (07) de Octubre de 2009, falleció ab-intestato el Ciudadano: E.J.R.P., quien era venezolano, mayor de edad, titular de la cédula de identidad Número V-16.588.039… según consta fehacientemente en el Acta de Defunción No. 13 emitida por el director del Registro Civil del Municipio S.B.d.E.Z.. Ahora bien…, pido a Usted, que previo el cumplimiento de las formalidades de ley, se sirva declarar a mi menor hijo plenamente identificado anteriormente, como ÚNICOS Y UNIVERSALES HEREDEROS, de los derechos que pudieren pertenecerle al Causante: E.J.R.P., anteriormente identificado, y le conceda el TÍTULO SUFICIENTE por no existir más herederos, todo de conformidad con lo establecido en el Art. 937 del Código de Procedimiento Civil…” (Sic).
Ahora bien, este Tribunal a decidir en los siguientes términos:
Se observa del Acta de Defunción correspondiente al ciudadano: E.J.R.P., que este falleció en fecha Siete (07) de Octubre de 2009. Asimismo, del Acta de Nacimiento correspondiente al niño: (SE OMITE SU NOMBRE, DE CONFORMIDAD CON LO ESTABLECIDO EN EL ARTICULO 65 DE LA LEY ORGÁNICA PARA LA PROTECCIÓN DEL NIÑO Y DEL ADOLESCENTE), se observa el vínculo filiatorio entre el mencionado ciudadano y el De Cujus, así como también se evidencia del Justificativo de Testigos evacuado por ante la Notaría Pública Segunda de Ciudad Ojeda Zulia, que el referido niño es el ÚNICO Y UNIVERSAL HEREDERO del ciudadano: E.J.R.P., en consecuencia, siendo este Tribunal el competente y por cuanto de los instrumentos antes mencionados se presume la relación entre los ciudadanos de autos, cumpliendo con lo establecido en los Artículos 936 y 937 del Código de Procedimiento Civil, para que sea declarado ÚNICO Y UNIVERSAL HEREDERO del mencionado causante. ASÍ SE DECLARA.-
