SENTENCIA DE SOBRESEIMIENTO
Visto el escrito presentado por la Abg. L.M. , en su carácter de Fiscal Primera del Ministerio Público del Segundo Circuito de la Circunscripción Judicial del Estado Sucre, mediante el cual solicita a este Tribunal de Control, EL SOBRESEIMIENTO DE LA CAUSA, seguida a C.M.U.O., por el delito de ABORTO SUFRIDO, previsto y sancionado en el artículo 434 del Código Penal, en perjuicio de S.M.G., hecho ocurrido en fecha 14-09-2003, de conformidad con lo establecido en el artículo 318 Ordinal 4 del Código Orgánico Procesal Penal, en virtud de no poder incorporar elementos nuevos a la investigación y no hay bases para solicitar fundadamente el enjuiciamiento del imputado .
Por todo lo antes expuesto y previo análisis de la presente causa, este Tribunal Cuarto de Control del Circuito Judicial Penal del Estado Sucre, Extensión Carúpano, Administrando Justicia en Nombre de la República Bolivariana de Venezuela por Autoridad de la Ley, DECRETA EL SOBRESEIMIENTO DE LA PRESENTE CAUSA POR NO HABER BASES PARA SOLICITAR FUNDADAMENTE EL ENJUICIAMIENTO DEL IMPUTADO, todo de conformidad con lo establecido en el artículo 318 Ordinal 4° del Código Orgánico Procesal Penal. Se estima que no es necesario fijar audiencia oral para debatir los fundamentos de la petición. En Conformidad con el artículo 323 del Código Orgánico Procesal Penal. En consecuencia se ordena notificar a las partes de la presente decisión, remítase la causa a la Fase de Ejecución en su debida oportunidad. Líbrense Notificaciones.
