En el día hábil de hoy 23 de Enero del año 2007, siendo las 11:00 AM, oportunidad fijada para que tenga lugar la Audiencia Preliminar, se dejó expresa constancia que la parte actora no compareció a la realización de la Audiencia Preliminar, compareciendo solo la parte demandada TRANSPORTE EL MORRO C.A., representada por su apoderada judicial S.C.A., debidamente inscrita en el I.P.S.A. bajo el N° 20.852, carácter acreditado en autos y por SEGUROS BANCENTRO S.A, representados por su apoderado judicial: DILLA SAAB, inscritos en el I.P.S.A. bajo el N° 67.142, y TRANSEGURO C.A DE SEGUROS representados por su apoderado judicial: DILLA SAAB, inscrito en el I.P.S.A. bajo el N° 67.142,. Por cuanto este tribunal observa que se dejó constancia que la Parte Actora no compareció a la realización de la Audiencia Preliminar, por lo que de conformidad con lo previsto en el artículo 130 de la Ley Orgánica Procesal del Trabajo, este Juzgado Noveno de Primera Instancia de Sustanciación, Mediación y Ejecución en nombre de la Republica Bolivariana de Venezuela y por Autoridad de la Ley CONSIDERA DESISTIDO EL PROCEDIMIENTO Y TERMINADO EL PROCESO. Publíquese y Regístrese la presente decisión. Déjese copia certificada.
