Nueva Ley de Participación Estudiantil en el Subsistema de Educación Básica

Esta norma tiene como objeto promover y desarrollar los medios para la participación de los estudiantes en el Subsistema de Educación Básica, con el fin de garantizar la educación como un derecho humano.
¿Qué es el Subsistema de Educación Básica?
De acuerdo con lo señalado en la Ley Orgánica de Educación (Gaceta Oficial No. 5.929 Extraordinario del 15 de agosto de 2009) en adelante “LOE”, el Subsistema de Educación es uno de los segmentos que componen el Sistema Educativo venezolano.
Este subsistema está integrado por los niveles de educación inicial, educación primaria y educación media. El nivel de educación inicial comprende las etapas de maternal y preescolar destinadas a la educación de niños y niñas con edades comprendidas entre 0 y 6 años. El nivel de educación primaria comprende 6 años y conduce a la obtención del certificado de educación primaria. El nivel de educación media comprende dos opciones: educación media general con duración de 5 años, de primero a quinto año, y educación media técnica con duración de 6 años, de primero a sexto año (artículo 25 de la LOE).
¿Cuáles derechos consagra esta nueva Ley?
Entre los derechos más relevantes incorporados en esta Ley, en beneficio de los estudiantes, tenemos los siguientes:

Derecho a la participación en el Subsistema de Educación Básica, en lo relativo a la planificación, ejecución y gestión del mismo (artículo 4).

Derecho a la participación en condiciones de igualdad sin discriminación (artículo 5).

Derecho a la participación de los estudiantes indígenas mediando siempre el respeto de sus usos, costumbres y entorno socio cultural indígena (artículo 7) al igual que la participación de los estudiantes con discapacidad (artículo 8).

Derecho a la libre asociación en el ámbito escolar. De conformidad con el artículo 12, los estudiantes podrán asociarse con fines “sociales, culturales, deportivos, recreativos, ecológicos, religiosos, políticos, económicos, laborales o de cualquier otra...
