En el día hábil de hoy, siete (07 de diciembre del dos mil seis (2006), siendo las once y treinta (11:30 a.m.) horas de la mañana, día y hora fijados para que tenga lugar el inicio de la Audiencia Preliminar, compareció a la misma el profesional del derecho G.J., en su condición de apoderado judicial de la parte demandada, quien en este acto presentó documento poder en original y copia para su certificación en autos, que acredita su representación por una parte. Se deja expresa constancia de que la parte actora no compareció a la celebración de la Audiencia Preliminar, ni por si ni por medio de apoderado judicial alguno; por lo que de conformidad con lo previsto en el artículo 130 de la Ley Orgánica Procesal del Trabajo, este Juzgado Tercero de Sustanciación, Mediación y Ejecución de Primera Instancia del Trabajo, en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley CONSIDERA DESISTIDO EL PROCEDIMIENTO Y TERMINADO EL PROCESO.
