San Cristóbal, 27 de Julio de 2009.
Visto el escrito presentado por el Director del Centro de Tratamiento Comunitario Masculino, mediante el cual presenta un informe sobre la progresividad del penado T.C.E. y su conducta en dicho centro, a fin de tramitar la solicitud de permiso para laborar en una empresa de seguridad.
Si bien es cierto el equipo técnico considera que el mencionado penado residente ha tenido una conducta intachable y ha cumplido con sus condiciones en el Centro, no menos cierto es que solo tiene tres (03) meses en disfrute del mismo, y la oferta de trabajo indica que el penado portara armas lo cual esta totalmente prohibido en su condición actual. Lo que hace improcedente que el penado tome la oferta laboral presentada, ya que debe cumplir con los requisitos que exige la ley.
Por todos los razonamientos antes expuestos, este JUZGADO TERCERO DE PRIMERA INSTANCIA PENAL EN FUNCIÓN DE EJECUCIÓN DE PENAS Y MEDIDAS DE SEGURIDAD, DEL CIRCUITO JUDICIAL PENAL DEL ESTADO TÁCHIRA, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPÚBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, DECIDE: ÚNICO: Niega la solicitud de permiso para la oferta de trabajo presecada por el penado T.C.E..
