EXPEDIENTE Nº 6032-06
Corresponde a esta Sala decidir acerca de la admisibilidad del Recurso de Apelación intentado por el Abogado: Á.R.B., en su carácter de Fiscal Décimo del Ministerio Público del Estado Miranda; contra el Auto Fundado emanado del JUZGADO PRIMERO DE PRIMERA INSTANCIA EN FUNCIONES DE EJECUCIÓN DEL CIRCUITO JUDICIAL PENAL DEL ESTADO M.E.B. en fecha 21 de marzo de 2.006, mediante la cual el Órgano Jurisdiccional prenombrado AUTORIZA al penado MANUEL HUIZI PÉREZ a fin de que dé cumplimiento al SERVICIO MILITAR previsto en el artículo 134 de la Constitución de la República Bolivariana de Venezuela, hasta septiembre de 2007, oportunidad a partir de la cual continuará dando cumplimiento al resto de la pena que le falte por cumplir, por medio de la formula alternativa de cumplimiento de pena o condiciones correspondientes.
DE LA ADMISIBILIDAD
El recurso referido fue ejercido con fundamento en el numeral 4° del Artículo 447 del Código Orgánico Procesal Penal, dentro del término que establece el artículo 448 ejusdem y no incurso en causal de inadmisibilidad alguna de las taxativamente previstas en el artículo 437 ibidem.
Establece el artículo 437 del Código Orgánico Procesal Penal, las causales de inadmisibilidad del recurso de apelación y son las siguientes:

Cuando la parte que lo interponga carezca de legitimidad para hacerlo.

Cuando el recurso se interponga extemporáneamente
-
Cuando la decisión que se recurra sea inimpugnable o irrecurrible por disposición expresa de la ley.
Legitimación del Recurrente
La legitimación del apelante se encuentra acreditada en autos, por ser el Representante del Ministerio Público.
El tiempo hábil para ejercer el Recurso
En cuanto al tiempo procesal en que fue ejercido el recurso de apelación en contra de la decisión dictada en fecha 21 de marzo de 2006, por el Tribunal Primero de Primera Instancia en Funciones de Ejecución, de este Circuito Judicial Penal Extensión Barlovento, se observa que el escrito del Recurso de Apelación, fue interpuesto el día 28 de abril del mismo año, por lo cual fue ejercido validamente en tiempo oportuno, como lo prevé el artículo 448 en relación con el artículo 172 del Código Orgánico Procesal Penal.
Recurribilidad del Recurso:
Es recurrible, según lo establecido en el numeral 4 del artículo 447 del Código Orgánico Procesal Penal. En consecuencia, resulta admisible el recurso de apelación interpuesto por el Profesional del Derecho ABG. Á.R.B., en sus carácter de Fiscal Décimo del Ministerio Público del Estado Miranda, en contra de la decisión dictada en fecha 21 de marzo de 2006 por el Tribunal Primero de Ejecución de este Circuito Judicial Penal Extensión Barlovento. Y ASÍ SE DECLARA.
En consecuencia, por cuanto el recurso de apelación fue interpuesto fundamentado en causa legalmente preestablecida, dentro del respectivo término legal y encontrándose legitimado el recurrente, debe admitirse el recurso interpuesto. Y ASÍ SE DECLARA.
DISPOSITIVA
Por los razonamientos expuestos con anterioridad, esta CORTE DE APELACIONES DEL CIRCUITO JUDICIAL PENAL DEL ESTADO MIRANDA, Administrando Justicia en nombre de la República Bolivariana de Venezuela y por autoridad de la Ley, emite el siguiente pronunciamiento:
ADMITE el Recurso de Apelación intentado por el Abogado: Á.R.B., en su carácter de Fiscal Décimo del Ministerio Público del Estado Miranda; contra el Auto Fundado emanado del JUZGADO PRIMERO DE PRIMERA INSTANCIA EN FUNCIONES DE EJECUCIÓN DEL CIRCUITO JUDICIAL PENAL DEL ESTADO M.E.B. en fecha 21 de marzo de 2.006, mediante la cual el Órgano Jurisdiccional prenombrado AUTORIZA al penado MANUEL HUIZI PÉREZ a fin de que dé cumplimiento al SERVICIO MILITAR previsto en el artículo 134 de la Constitución de la República Bolivariana de Venezuela, hasta septiembre de 2007, oportunidad a partir de la cual continuará dando cumplimiento al resto de la pena que le falte por cumplir, por medio de la formula alternativa de cumplimiento de pena o condiciones correspondientes.
