Visto el escrito de fecha once (11) de agosto de 2.011, interpuesto por el Abogado R.L.B.M., en su condición de Procurador General del Estado Sucre, mediante el cual solicita se deje sin efecto la Notificación de la Procuraduría General de la República y se de continuidad a la presente causa, con fundamento en que los intereses patrimoniales vulnerados en el presente caso forman parte de la esfera del Estado Sucre, y por ende el Juzgado Superior en lo Civil y Contencioso Administrativo de la Región Nor-Oriental no debió ordenar dicha notificación, a tal efecto, este Juzgado observa:

Ha sido criterio reiterado de las Cortes de lo Contencioso Administrativo que en las demandas de contenido patrimonial intentadas por las Entidades Federales, se ordene la Notificación de la Procuraduría General de la República y que la causa continué una vez que conste en autos las citaciones y notificaciones ordenadas, y transcurridos los noventa (90) días a que alude el artículo 96 del Decreto con Rango, Valor y Fuerza de Ley de Reforma Parcial del Decreto con Fuerza de Ley Orgánica de la Procuraduría General de la República. En tal sentido, se cita la Sentencia de fecha once (11) de agosto de dos mil once (2011), emanada de la Corte Segunda de lo Contencioso Administrativo, caso ENTIDAD FEDERAL MÉRIDA, contra la sociedad mercantil GRUPO S.I., C.A., con ponencia del magistrado Emilio Ramos González.

En consecuencia, este Juzgado Superior acuerda ratificar lo ordenado en el auto de admisión de la demanda dictado en fecha veintiuno (21) de julio de 2.010, por el Juzgado Superior en lo Civil y Contencioso Administrativo de la Circunscripción Judicial de la Región Nor-Oriental. Líbrese lo conducente.

Dada, firmada y sellada en la Sala de Despacho del Juzgado Superior Estadal en lo Contencioso Administrativo de la Circunscripción Judicial del Estado Sucre, a los diecinueve (19) días del mes de septiembre del 2011. Años: 201° de la Independencia y 152° de la Federación.
