Celebrada como ha sido el día 18 de Agosto de 2016, la Audiencia de Especial, convocada de conformidad con lo establecido en el artículo 295 del Código Orgánico Procesal Penal, en el presente asunto seguido a R.E.C.S., C.E.S.M., M.A. FARIAS AMARISTA, GLAIGLORIS M.M.S., YIRDA M.F.A. y DEYALKIS D.B.S..
DE LA DEFENSA
ratifico escrito presentado en fecha 20-07-2016, donde la defensa solicito al tribunal, en virtud que a mi representado se le otorgo una medida de presentación cada quince (15) días por el lapso de ocho (08) meses, el cual ha venido cumplimiento a cabalidad, motivo por el cual solicito al tribunal de conformidad con lo establecido en el artículo 295 del COPP se fije un plazo prudencial a la representación de Fiscal, para la presentación del Acto Conclusivo correspondiente, es todo.
PRONUNCIAMIENTO DEL TRIBUNAL
“Concluido el desarrollo de la presente Audiencia Especial convocada de conformidad con lo establecido en el artículo 295 del Código Orgánico Procesal Penal, en el presente asunto seguido a R.E.C.S., C.E.S.M., M.A. FARIAS AMARISTA, GLAIGLORIS M.M.S., YIRDA M.F.A. y DEYALKIS D.B.S.; por la presunta comisión de los de RIÑA COLECTIVA CON LESIONES RECIPROCAS y ALTERACION AL ORDEN PUBLICO, previstos y sancionados en los artículos 425 en concordancia con el 413 y 285 del Código Penal Venezolano, respectivamente; en perjuicio de EL ESTADO VENEZOLANO, quien ratifica su solicitud de fecha 20-07-2016.
DISPOSITIVA
Este Tribunal Penal de Primera Instancia Estadales y Municipales en Funciones de Control Nº 05 del Circuito Judicial Penal del Estado Sucre, Extensión Carúpano Administrando Justicia en Nombre de la República Bolivariana de Venezuela y por Autoridad de la Ley, Acuerda: Fijar un Plazo Prudencial de cuarenta y cinco (45) días a la representación de la Fiscalía Superior del Ministerio Público, para que concluya con la investigación y presente el correspondiente Acto Conclusivo en el presente asunto seguido a los ciudadanos R.E.C.S., C.E.S.M., M.A. FARIAS AMARISTA, GLAIGLORIS M.M.S., YIRDA M.F.A. y DEYALKIS D.B.S., por la presunta comisión delito de RIÑA COLECTIVA CON LESIONES RECIPROCAS y ALTERACION AL ORDEN PUBLICO, previstos y sancionados en los artículos 425 en concordancia con el 413 y 285 del Código Penal Venezolano, respectivamente; en perjuicio de EL ESTADO VENEZOLANO, todo de conformidad con lo establecido en el artículo 295 del Código Orgánico Procesal Penal. Se acuerda remitir las presentes actuaciones a la Fiscalía Superior del Ministerio Publico, a los fines de ser agregadas a la causa principal. Quedan Notificadas las partes presentes en sala de conformidad con lo establecido en el artículo 159 del Código Orgánico Procesal Penal. Es todo, terminó, se leyó, y conformes firman. Cúmplase.-
