¿Cuál es el objeto de la Resolución y a cuáles entidades aplica?
Crear un registro que funcione como una base de datos “on line” de las organizaciones no gubernamentales (en adelante “ONG”) no domiciliadas en Venezuela, sin fines de lucro, con el propósito de regular y hacer seguimiento a las actividades que realizan en el país, a través de una sede o representación, excluyendo expresamente a personas jurídicas no domiciliadas en el país que realizan actividades con fines de lucro y a aquellas organizaciones domiciliadas en el país, es decir, aquellas que adquirieron su personalidad jurídica mediante la constitución en una oficina de registro venezolana.
¿Qué debe entenderse por una ONG no domiciliada en Venezuela?
Toda organización de carácter privado que: (i) no tiene fines de lucro; (ii) no se encuentra operada ni directa ni indirectamente por un Estado; (iii) no tiene domicilio en Venezuela; y (iv) está constituida formalmente y regulada su existencia, capacidad, funcionamiento y extinción por un ordenamiento jurídico extranjero.
