JUZGADO TERCERO DE LOS MUNICIPIOS SAN CRISTOBAL Y TORBES DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO TACHIRA, San Cristóbal, veinte de julio de dos mil cinco.
195° y 146°
Asumidas como han sido las funciones de quien suscribe, como Jueza temporal de este Juzgado, ME AVOCO al conocimiento de la presente causa, y en base al artículo 26 de la Constitución de la República Bolivariana de Venezuela, en concordancia con el artículo 257 ejusdem, se continúa el proceso en el estado en que se encuentra. En tal virtud vistas las actas procesales que conforman el presente expediente N° 2979, contentivo del juicio de COBRO DE BOLIVARES POR INTIMACIÓN, seguido por el abogado R.A.U., Endosatario en Procuración, contra la Sociedad Mercantil CONTRATISTA PRIETO C. A., (CONPRICA), R.D.P. y A.B.D.P., titulares de las cédulas de identidad Nos. V-7.625.218 y V-1.829.104, respectivamente; de las cuales se desprende, que en el acta de embargo practicado por el extinto Juzgado Segundo de Parroquia de los Municipios Maracaibo, J.E.L. y San Francisco de la Circunscripción Judicial del Estado Zulia, de fecha 03 de junio de 1996, las partes intervinientes en el juicio, celebraron un convenimiento; en tal sentido este tribunal a tenor de lo pautado en el artículo 263 del Código de Procedimiento Civil le imparte SU HOMOLOGACIÓN al convenimiento suscrito entre las partes, en razón de que el mismo no es contrario a derecho y versa sobre derechos disponibles. En cuanto a la medida decretada se resolverá por auto separado.
Déjese copia certificada e esta decisión para el archivo del Tribunal.
