JUZGADO AGRARIO PRIMERO DE PRIMERA INSTANCIA DE LA CIRCUNSCRIPCIÓN JUDICIAL DEL ESTADO CARABOBO

Vista la diligencia del 20/01/2016, mediante la cual el alguacil de este Juzgado Agrario, consignó sin firmar las boletas de citaciones libradas a los ciudadanos M.A.D.C.F. y R.A.A.R., relativas a la Medida Cautelar Asegurativa de Protección a los Suelos y Cultivos, decretada por éste Juzgado Agrario en fecha 13/01/2016. A tal efecto, este Tribunal en garantía de los principios constitucionales previstos en los artículos 2 “Estado Democrático, Social y de Justicia”, 7 “Primacía Constitucional”, 26 “Tutela Judicial Efectiva”, 49 “Debido Proceso”, 257 “Eficacia Procesal”, 127 “Conservación del Medio Ambiente” y 305 “Seguridad y Soberanía Agroalimentaria”; en concordancia con lo establecido en los articulo 202 de la Ley de Tierras y Desarrollo Agrario y 602 del Código de Procedimiento Civil, ordena librar un único Cartel de Emplazamiento a los ciudadanos M.A.D.C.F. y R.A.A.R., venezolanos, titulares de las cedulas de identidad Nros. V.-7.063.117 y V.- 4.451.388, y de este domicilio, respectivamente. En tal sentido, se procederá a fijar un cartel en el predio objeto de la presente Medida Cautelar y otro en la cartelera de este Juzgado Agrario. Dicho Cartel contendrá el nombre y apellido de las partes, el objeto de la pretensión, el término de la comparecencia, apercibiéndole que en caso de no acudir, su citación se entenderá con el funcionario al cual corresponda la defensa de los beneficiarios de la Ley ya indicada, esto es, la Defensa Pública Agraria del estado Carabobo. Líbrese Cartel en la forma indicada.
