REPÚBLICA BOLIVARIANA DE VENEZUELA
JUZGADO SUPERIOR SEGUNDO EN LO CIVIL Y CONTENCIOSO ADMINISTRATIVO DE LA CIRCUNSCRIPCIÓN JUDICIAL DE LA REGIÓN CAPITAL. Caracas, primero (01) de diciembre de dos mil once (2011).
201° y 152°
Vistas las pruebas promovidas por el abogado en ejercicio J.G. CASTELLINI PÉREZ, inscrito en el Inpreabogado bajo el No. 124.258, actuando en su carácter de apoderado judicial de la ciudadana T.M.B.B., venezolana, mayor de edad, titular de la Cédula de Identidad Nro V-3.245.808, así como las promovidas por las abogadas G.H.P.P., N.H.R. y G.T.T., inscritas en el Inpreabogado bajo los Nos. 62.903, 114.515 y 139.760, actuando en su carácter de apoderadas judiciales de la Contraloría Municipal del Municipio Chacao del Estado Miranda, y siendo su oportunidad para su admisión, el Tribunal observa:
Que de conformidad con lo establecido en el artículo 398 del Código de Procedimiento Civil, las pruebas serán inadmitidas cuando sean manifiestamente ilegales e impertinentes.
En relación con los Capítulos I y II, del escrito de la parte querellante, así como el Capítulo I, de la parte querellada, relativos al merito favorable de los autos y documentales cursantes en autos, se señala que los mismos no son objeto de promoción, toda vez que el Juez está obligado de conformidad con lo establecido en el artículo 12 del Código de Procedimiento Civil, a a.t.l.a.y. probado en autos, sin poder sacar elementos de convicción fuera de éstos.
En cuanto a las documentales promovidas, en el Capítulo II del escrito presentado por la accionada, este Juzgado por cuanto las mismas no son manifiestamente ilegales ni impertinentes, las admite salvo su apreciación en la definitiva de conformidad con lo establecido en los artículos 429 y siguientes ejusdem.
