ASUNTO: KP02-S-2007-14261
Vista la solicitud que procede suscrita por la ciudadana: T.Y.P. venezolana mayor de edad, titular de la cedula de identidad número V.-10.053.623, de este domicilio, conforme a lo cual manifiesta haber construido unas mejoras y bienhechurías que tiene un valor aproximado TRES MILLONES DE BOLIVARES (Bs.3.000.000,00), cuya situación y linderos constan en dicha solicitud y careciendo de un título que le acredite el derecho de propiedad y posesión sobre las mejoras o bienhechurías; solicita que se le declare bastante y suficiente la justificación evacuada para asegurar el derecho de propiedad y posesión sobre las mejoras o bienhechurías antes dichas. Este Tribunal considera que de la justificación aludida conforme a las testimoniales rendidas por los testigos suficientemente identificados en auto, se evidencia claramente las pretensiones y fundamentos del solicitante y procediendo de conformidad con el artículo 937 del Código de Procedimiento Civil, declara bastante y suficiente la justificación evacuada para asegurar el derecho de propiedad y posesión a favor de la ciudadana, T.Y.P. sobre unas mejoras o bienhechurías ubicadas en: EL BARRIO CERRITOS BLANCOS, CALLE 4 CON CALLE 12, CALLEJON ASFALTADO, BARQUISIMETO, JURISDICCION DE LA PARROQUIA JUAN DE VILLEGAS, MUNICIPIO IRIBARREN DEL ESTADO LARA, y alinderadas en: NORTE: Con Matilde, Yépez SUR: Con callejón asfaltado que es su frente ESTE: Con propiedad de K.L. y OESTE: Con cerro Mara; Dejando a salvo, derechos de terceras personas
